1. Acceptance of Terms
By accessing or using Batonship's AI-augmented engineering assessment platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users, including developers taking assessments and organizations using Batonship for hiring and evaluation purposes.
2. Service Description
Batonship provides a platform for assessing AI-augmented software engineering skills through:
- Timed coding assessments with AI assistance
- Skill evaluation across five dimensions (Prompting, Context Provision, Agent Orchestration, Verification, Adaptability)
- Generation of Batonship Scores and skill reports
- Certification and credential sharing with employers
3. Account Registration and Security
To use the Service, you must:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Be at least 18 years of age
- Notify us immediately of any unauthorized access
You are responsible for all activities that occur under your account.
4. Assessment Integrity and Prohibited Conduct
When taking Batonship Assessments, you agree to:
- Complete assessments independently without unauthorized assistance
- Not share assessment content, questions, or solutions
- Not use multiple accounts to retake assessments
- Not attempt to manipulate, reverse-engineer, or circumvent scoring systems
- Not use automated tools or scripts except as provided by the platform
Violation of assessment integrity rules may result in score invalidation, account suspension, or termination.
5. Payment and Refunds
Pricing
Certification pricing is as follows:
- Foundations Certification: $49
- Professional Certification: $99
- Architect Certification: $149
Refund Policy
Refunds are available under the following conditions:
- Full refund if you have not started the assessment
- No refunds once an assessment has been initiated
- Technical issues: Contact support within 24 hours for case-by-case review
6. Intellectual Property
Our Rights
Batonship owns all rights to:
- The platform, software, and technology
- Assessment challenges, scoring algorithms, and methodologies
- Batonship branding, trademarks, and logos
Your Content
You retain ownership of code you submit during assessments. By using the Service, you grant Batonship a license to:
- Process and evaluate your submissions
- Use anonymized data for algorithm improvement and research
- Display your scores and achievements as you authorize
7. Scores and Certifications
Batonship Scores and certifications:
- Are valid for 12 months from the assessment date
- Reflect your performance at the time of assessment
- May be shared with employers at your discretion
- Can be revoked if assessment integrity violations are discovered
We reserve the right to update scoring methodologies. Score recalculations will only apply to new assessments, not retroactively.
8. Disclaimers and Limitations of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:
- Uninterrupted or error-free operation
- Employment or specific outcomes from using the Service
- Accuracy of third-party content or integrations
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BATONSHIP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
9. Indemnification
You agree to indemnify and hold Batonship harmless from any claims, damages, losses, or expenses arising from your violation of these Terms or misuse of the Service.
10. Termination
We may suspend or terminate your access to the Service:
- For violation of these Terms
- For fraudulent or abusive behavior
- At our discretion with or without cause
Upon termination, your right to use the Service will immediately cease. Completed certifications will remain valid unless revoked for cause.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
